ARTICLE 1: SCOPE OF APPLICATION

1.1 - These general conditions of sale govern, exclusively, the contractual relations between COULEUR SAFRAN, and any adult natural person (hereinafter referred to as "the CUSTOMER") who places an order on the merchant Internet SITE (hereinafter referred to as "the SITE") via the following address: www.couleursafran.com
1.2 - This SITE is published by COULEUR SAFRAN, a simplified joint-stock company with a capital of €2,500, registered in the CANNES Trade Register under number 804 610 509 00015, whose registered office is located at: 12 rue Reyer 06400 CANNES, Tel: 06 30 16 44 06 E-mail: contact@couleursafran.com. This site is attached to COULEUR SAFRAN located at 12 rue Reyer 06400 CANNES.
1.3 - These general conditions are applicable to all items offered for sale on the SITE, and are reserved for CUSTOMERS who are natural persons over 18 years of age and who have full legal capacity.
1.4 - Any order for one or more items presented on the SITE implies consultation and unreserved acceptance, on the part of the CUSTOMER, of these general conditions of sale as well as the prices applied. These conditions prevail over any other document.

ARTICLE 2: INFORMATION RELATING TO THE ARTICLES

2.1 - The items and promotional offers on the SITE are offered for sale while stocks last and for offers, until the end of their validity. The presence of an item on the SITE does not guarantee its availability in stock.
2.2 - All items on the SITE presented for sale are reserved for individuals, natural persons of legal age. Orders exceeding 10 items per reference must be subject to specific validation. COULEUR SAFRAN reserves the right to refuse any order whose quantities appear excessive in the context of normal use by an individual.
2.3 - The photographs and texts illustrating the articles are provided for information purposes only and are not contractually binding. Consequently, although represented on the SITE with the greatest precision, the photos and texts may, however, contain errors. In this case, COULEUR SAFRAN cannot be held liable. Only the instructions provided with or on the product by the manufacturer should be taken into consideration by the customer. Do not hesitate to contact us before placing your order to ensure the composition of a product.

ARTICLE 3: ORDERING ITEMS

3.1 - Orders are placed on the SITE at the following address: www.couleursafran.com. The items offered for sale are subject to availability. In the event that a product is unavailable, the CUSTOMER will be informed, after placing their order, by email or by post. The order will only be validated when the CUSTOMER has paid in full. COULEUR SAFRAN reserves the right to refuse certain orders, particularly when all payment security steps have not been validated.
3.2 - Order validation: If the CUSTOMER wishes to purchase one or more items, they must select a model or its reference, define the quantity and then click on "basket". The basket summarizes the CUSTOMER's selection and allows them to modify their order. To validate the chosen products, the CUSTOMER must click on "order". Once this step is completed, they will identify themselves, either using their CUSTOMER code or by entering their personal data in the space provided for this purpose. They will then have to choose their payment method, pay the amount of the order and then validate the information appearing on the final order form. An order number will be assigned to the CUSTOMER. COULEUR SAFRAN will keep the order record as proof of the contractual relationship between the parties. The CUSTOMER will receive an order registration email "awaiting payment verification", then a second confirmation or cancellation email after verification with the payment center (PAYPAL). He may also receive an email offering to contact COULEUR SAFRAN by telephone at 06 30 16 44 06 to offer him another payment alternative.

ARTICLE 4: PRICE OF ITEMS

The prices indicated on the SITE are in euros and include all taxes (French VAT included). Any possible change in the legal rate of French VAT will be reflected in the price of the products presented on the SITE. The prices do not include shipping and packaging costs, which are the responsibility of the CUSTOMER and will be specified to them when registering their order. The prices presented may be modified at any time by COULEUR SAFRAN. However, the products are invoiced based on the prices in effect at the time the orders are registered. Any discounts do not apply to crossed-out prices, and discount codes cannot be combined.

Purchase excluding VAT and customs fees
For destinations outside the European Union DOM and TOM, the basket total is displayed excluding VAT.
The amount paid excluding tax (HT), does not include any taxes, duties and customs fees payable by the customer in the destination country. The amount of customs fees can be significant, we invite you to inquire about the import conditions of your destination country before placing your order.
In the event of refusal of delivery and return of the package to the sender, all costs incurred will be deducted from the refund.

ARTICLE 5: PAYMENT AND SECURITY

When paying for their order, the CUSTOMER will have the choice between the following payment methods:

• Payment by Paypal or credit card (except server unavailability)

• Payment by check
  5.1 - Terms and conditions for payment by credit card: The CUSTOMER may pay for their purchases directly on the SITE. The amount of the order will only be debited upon validation. Payment by Paypal or credit card is secured by an encryption system. Consequently, COULEUR SAFRAN cannot access the CUSTOMER's card number, which is transmitted in complete confidentiality. Only national bank cards will be accepted by the security system, as well as Visa, Eurocard, and Mastercard cards.
  5.2 - Terms and conditions for payment by check: The CUSTOMER may send, by mail, a bank check, made payable to COULEUR SAFRAN, accompanied by a photocopy of their passport or identity card, to the following address: COULEUR SAFRAN – 12 rue Reyer – 06400 CANNES. The check will be deposited in the bank, for collection, upon receipt, and we will then proceed with the dispatch of the order.
  5.3 - For all payment methods, the purchase amount must be paid in full and in one payment on the day of the order. Orders will be validated and processed, after acceptance of payment, by the relevant banking centers (for payments by credit card, Visa, Eurocard, Mastercard) or after receipt of payment (for bank checks). In the event of a payment dispute with a CUSTOMER, COULEUR SAFRAN reserves the right to refuse their order.

ARTICLE 6: DELIVERY

6.1 - Shipping Methods: Orders can be delivered to France and EEC countries at the indicated rates. COULEUR SAFRAN reserves the right to choose the appropriate shipping method. Orders will be delivered to France by La Poste (So colissimo, lettre MAX, Access or Expert) or another operator.
It is expressly agreed that the transfer of ownership of the ordered goods becomes effective upon their departure from our premises. The buyer therefore agrees to accept all risks, in particular those relating to transport, except in the case of transport provided by the seller or one of its agents. It is the buyer's responsibility to make, where applicable, the usual reservations before taking delivery. In the absence of instructions from the buyer relating to shipping, the seller reserves the right to have the goods transported as best as possible, without incurring any liability as a result. In the event that it is impossible to transport the ordered goods to the buyer's home due to inadequate means of access to said premises or due to their cramped conditions, the seller may under no circumstances be held liable, unless expressly informed of this when ordering.
6.2 - Delivery of the products will only be effective after receipt of the total amount of the order. The products will be delivered to the address indicated by the CUSTOMER when placing the order. Consequently, the contact details provided by the CUSTOMER are considered accurate and will not engage, in the event of a dispute, the liability of COULEUR SAFRAN. The CUSTOMER must have a mailbox in their name, or that of the person with whom they reside, if applicable. They must also provide all the building's access codes as well as any door, floor, or apartment numbers. COULEUR SAFRAN cannot be held responsible in the event that delivery cannot be made due to an addressing error made by the customer. The contribution to shipping costs will be invoiced for a reshipment. In the event of a refund, the actual shipping costs incurred will be deducted, as the service has been performed. If the CUSTOMER is absent at the time of delivery, the carrier will leave a calling card at the address indicated. Packages worth less than 100 euros are delivered without a signature. A package marked as delivered by the La Poste information system (which constitutes proof of delivery) cannot be the subject of a claim against our services.
The CUSTOMER has the option of choosing delivery with signature for packages under 100 euros. In the case of delivery with signature, if the CUSTOMER has not received their package, an investigation will be opened with the Post Office, after receipt of your documents (sworn statement and copy of ID). Provided the claim is accepted by the Post Office, we will proceed with compensation. In the case of delivery without signature, the tracking information is valid. A package indicated as delivered will be considered as such and cannot be subject to any compensation.
6.3 - The average delivery time is 48 hours. This is given for information purposes only and does not constitute a firm commitment on our part. Colissimo Suivi is a very reliable service. However, as with any shipment, there may be a delay in delivery or the product may go astray. In the event of a delay in delivery compared to the expected receipt date (indicated in the shipping email), COULEUR SAFRAN asks you to report this delay by calling 06 30 16 44 06 or by sending an email to contact@couleursafran.com. COULEUR SAFRAN will then contact the Post Office or Mondial Relay to initiate an investigation. A Post Office investigation can last up to 30 days from the start date of the investigation. If the product is found during this period, it will be immediately re-routed to your home (in the majority of cases). If, on the other hand, the product is not found after the 30-day investigation period, La Poste or Mondial Relay will consider the package as lost.

Any refund request can only be granted upon receipt of the returned package at our premises. Unfortunately, we will not be able to refund an order that is stuck in a closed relay point or any other situation that prevents delivery of the order within the announced timeframe.
6.4 - Delivery outside mainland France: The shipping costs indicated when placing the order and the delivery times only apply to deliveries within mainland France. Delivery rates outside mainland France will be calculated as soon as the CUSTOMER has specified the country to which they wish to be delivered.
6.5 – The CUSTOMER receives an email with their parcel number upon dispatch of their order. The CUSTOMER can track the progress of their parcel via the link provided in the email.
6.6 - Receipt of products: The CUSTOMER is advised to check the condition of the products received before signing the delivery slip. Once the slip has been signed, COULEUR SAFRAN will consider that the CUSTOMER has carried out this check. For more information regarding the receipt of a package:
http://www.colissimo.fr/particuliers/Aide/Questions_Reponses/Recevoir_un_colis/recevoir.jsp. In the event of an anomaly with the package received, the CUSTOMER is required to report the problem by email or telephone within 24 working hours so that the claim is admissible by the carrier.
6.7 - Order processing and shipping: every order is important. We make every effort to ensure it is delivered to you as quickly as possible: Orders are processed within 24 working hours and entrusted to the postal services by Colissimo at 12 p.m. Except in cases of force majeure (strikes, bad weather, prefectural orders or periods of high traffic), they are delivered within 48 to 72 hours (working days) by Colissimo. Public holidays are equivalent to a Saturday or Sunday.
6.8 – Chronopost 13 Express delivery outside Corsica and Monaco: Subject to product availability, orders placed before 1 p.m. are delivered the next day before 1 p.m. from Monday to Saturday. Orders placed from Friday after 1 p.m. to Monday before 12 p.m. are delivered on Tuesday.
In the event of product unavailability, COULEUR SAFRAN will contact the CUSTOMER to inform them of the restocking deadlines. The customer may choose to cancel their order and receive a full refund, or to maintain their order with or without changing the delivery method. If, despite the restocking deadline, the CUSTOMER retains Chronopost 13 delivery, a new delivery date will be communicated to them, and the service will remain billed at the initial price. Otherwise, the CUSTOMER may choose standard delivery and will be based on the current SO colissimo delivery rate.

6.9 – Delivery by courier: Subject to product availability, orders placed before 1 p.m. (Monday to Friday) are delivered the same day before 6:30 p.m. In the event of product unavailability, COULEUR SAFRAN will contact the CUSTOMER to inform them of restocking times and to arrange a later delivery. The smooth running of the delivery is the customer's responsibility. The customer undertakes to be present at the delivery location and to be available to receive their package during the delivery time slot indicated. The CUSTOMER will provide all the necessary information to enable the delivery of their package in the best conditions (telephone number, access code, building, intercom, etc.). By written notice, they may appoint a third party to receive their package (neighbor, reception, caretaker, etc.). Any error in address, access code, or other events due to the CUSTOMER, such as the courier being unable to deliver due to the CUSTOMER being unavailable at the time of delivery, will be invoiced. The package can only be returned after payment by the CUSTOMER to COULEUR SAFRAN.
Orders that cannot be contained in a 30 x 30 x 20 cm package will be shipped by post. The customer will be notified. This delivery method is not suitable for packages weighing more than 3 kg. In this case, you may be asked to pay an additional fee before delivery.
From then on, same-day delivery before 6 p.m. will no longer be guaranteed. All costs incurred by COULEUR SAFRAN with MMS couriers will be due; the service having been performed.

ARTICLE 7: RIGHT OF WITHDRAWAL

7.1 - Pursuant to the provisions of Articles L.121-20 et seq. of the French Consumer Code, the CUSTOMER has a period of fourteen clear days from the date of receipt of their order to exercise their right of withdrawal without having to provide any reasons. Return costs will be borne by the CUSTOMER. The products must be returned by post, unopened, unused, in perfect condition and in their original packaging (including accessories and instructions for use) to the following address:

Refunds will be made by crediting the CUSTOMER's bank card, or by bank check, as soon as possible and at the latest within thirty days following the date on which the right of withdrawal was exercised. The transport service having been performed, only the goods will be refunded. If the actual transport costs are higher than the price paid, the actual amount may be deducted from the refund. In the event that the initial delivery costs were borne by COULEUR SAFRAN (order of an amount giving the right to a 'free shipping' delivery or in the event of a promotion) these costs will be deducted from the amount refunded to the customer.
If a product is returned that is damaged, incomplete or used, it will not be exchanged or refunded.

ARTICLE 8: CONFORMITY AND WARRANTY OF PRODUCTS

8.1 - In the event of non-conformity or hidden defect in the products, we ask the CUSTOMER to inform us by mail, accompanied by the items concerned, in new condition and in their original packaging, within 15 working days, to the following address:

8.2 - Guarantees: The CUSTOMER benefits from the legal provisions relating to the guarantee of hidden defects under article 1641 et seq. of the civil code.

ARTICLE 9: RETENTION OF TITLE AND TERMINATION CLAUSE

9.1 - The products ordered remain the property of COULEUR SAFRAN until the CUSTOMER fulfills its obligations, in particular until it pays the full price. Once the transfer of ownership has taken place, the risks of loss, theft or deterioration of the products are the responsibility of the CUSTOMER.
9.2 - In the event of a breach by the buyer of any of its obligations, the sale will be terminated automatically and without notice. The items must be returned to COULEUR SAFRAN within 48 hours.

ARTICLE 10: PERSONAL INFORMATION - PRIVACY POLICY

10.1 Consultation of the Site
In order for you to consult our SITE, we need to collect and store connection data and information already stored on your computer terminal (date, time, Internet Protocol address of your computer, pages consulted), by means of cookies (small text file placed on the hard drive by the Site Server, when you visit it). These cookies are necessary for the provision of the Site's services and are intended to facilitate communication by electronic means and to measure the Site's audience.

ARTICLE 11: INTELLECTUAL PROPERTY RIGHTS

The Site was developed by the company Milly Media Management.
All elements it contains (information, data, text, sounds, images, drawings, graphics, distinctive signs, logos, brands, etc.) are the exclusive property of the PUBLISHER, unless otherwise stated (in particular for the brands of all products offered for sale and their photographs).
All of these elements are subject to the provisions of the French Intellectual Property Code and, as such, are protected against any use not authorized by law or these conditions of use.
The PUBLISHER grants you, on a non-exclusive basis, a free, strictly personal and non-transferable license to use the SITE, valid only under the conditions set out in these general conditions for an unlimited period.
Any other reproduction, representation or distribution, in whole or in part, of the content of this SITE, on any medium or by any process whatsoever, is prohibited. Failure to comply with this prohibition constitutes an infringement that may incur the civil and criminal liability of the infringer.
You are also prohibited from decompiling or disassembling the Site, using it for commercial purposes or public performance or infringing in any way the copyright and intellectual property rights of the PUBLISHER or its partners.

ARTICLE 12: FORCE MAJEURE

In the event of partial or total non-performance of its obligations, caused by force majeure or unforeseeable circumstances, COULEUR SAFRAN shall not be liable. According to the provisions of Article 1148 of the Civil Code, force majeure is defined in a context of unpredictability and irresistibility. The following are expressly considered cases of force majeure:

• Strikes, in particular: strikes in transport, communications or postal services; regulatory restrictions; attacks...

• Floods, fires, lightning, natural disasters...

ARTICLE 13: LIABILITY FOR PRODUCTS SOLD ON THE SITE

13.1. COULEUR SAFRAN cannot under any circumstances or in any way be held liable for damages of any kind which may result from improper use of the products sold.
13.2. COULEUR SAFRAN cannot be held liable for any modifications to the products made by the manufacturers.
13.3. COULEUR SAFRAN's liability will, in any event, be limited to the amount of the order and cannot be held liable for simple errors or omissions that may have remained despite all the precautions taken in the presentation of the products. In particular, the photos on the SITE are provided for information purposes. Under no circumstances may a modification of the container or content of a product be invoked in the event of a discrepancy with the photo available on the SITE. The instructions published in the product sheets are for information purposes only. The CUSTOMER undertakes to carefully read the instructions displayed by the manufacturer on or in the product packaging. It is this instruction which contains the information (and in particular dosages and contraindications) that the user must respect.
13.4. Use of essential oils for therapeutic purposes: Essential oils are not harmless products and contain very high percentages of active substances. COULEUR SAFRAN does not encourage self-medication. The information provided on our SITE is for informational purposes only; it does not constitute medical information or engage the responsibility of COULEUR SAFRAN. For any use of essential oils for therapeutic purposes, we advise you to consult a doctor qualified in aromatherapy. In general, COULEUR SAFRAN advises against the use of essential oils for pregnant or breastfeeding women, people with epilepsy or serious health problems, or babies and children under 3 years old.

ARTICLE 14: TECHNICAL RESPONSIBILITY OF THE PUBLISHER

The PUBLISHER shall not be held liable for any defect or malfunction of the hardware or software you use and its possible consequences, in particular on your banking data, their use and cases of force majeure or similar.
The PUBLISHER is not involved in any dispute that may arise between you and the Internet service provider and/or the ticketing service provider.
The PUBLISHER is not responsible for any consequences of a security defect (hardware or software) or of the browser you use.
You are responsible for all consequences resulting from an error in transmission or handling on its part.
We make every effort to ensure that the SITE is accessible 24 hours a day, 7 days a week, but we cannot guarantee its continuous availability. Access to the Site may be interrupted, particularly in the event of force majeure, third-party actions and/or maintenance work and interventions necessary for its proper functioning.

ARTICLE 15: YOUR RESPONSIBILITY

You agree not to hinder in any way the proper functioning of the Site, in particular not to block or alter the normal flow of data, fraudulently access the Site's information system, disrupt it or modify it.
